The Top 10 Ways Internet Marketers Get into Trouble With the FTC

This is an interview with FTC Defense Attorney Nick Oberheiden of Oberheiden P.C. Nick handles FTC compliance and defense matters nationwide.

Despite what many people seem to think, the internet is not the wild west when it comes to oversight and enforcement. Several government agencies share responsibility for ensuring that internet marketers comply with the law, with the most-prominent being the U.S. Federal Trade Commission (FTC).

Internet marketers can (and do) run into problems with the FTC in a variety of different ways. While most FTC enforcement actions are civil (as opposed to criminal) in nature, internet marketers have faced criminal charges in some cases.

Even in civil cases, penalties can include hundreds of thousands, if not millions, of dollars in fines and damages. With this in mind, internet marketers need to take compliance seriously, and they need to take affirmative steps to ensure that they will be able to defend themselves effectively in the event of an FTC investigation.

So, what does this mean, exactly? Here are 10 ways internet marketers can get into trouble with the FTC—as well as some tips they can follow to mitigate their risk of liability:

1. Ignoring the FTC’s rules for online endorsements

The FTC defines an endorsement as, “any advertising message . . . that consumers are likely to believe reflects the opinions, beliefs, findings, or experiences of a party other than the sponsoring advertiser, even if the views expressed by that party are identical to those of the sponsoring advertiser.”

While there is nothing inherently unlawful about endorsing products or services online (or seeking endorsements from social media influencers), internet marketers must follow the FTC’s guidelines in order to remain compliant.

These guidelines appear in 16 CFR Section 255, and the FTC adopted them specifically to address what the agency identified as widespread misleading use of endorsements in the online realm.

Crucially, the FTC’s guidelines do not apply to all online endorsements. As the agency explains:

“If you mention a product you paid for yourself, there isn’t an issue. Nor is it an issue if you get the product for free because a store is giving out free samples to its customers.”

Where issues can arise is the endorsement of products for which the endorser receives compensation from the advertising party. Generally speaking, if an influencer or other endorser receives compensation for providing an endorsement, then the relationship needs to be disclosed.

However, rather than establishing a list of approved conduct and prohibitions, the FTC instead requires internet marketers to interpret its guidance and make their own decisions about what is permissible and what isn’t. This, of course, is easier said than done, and internet marketers who don’t invest the time necessary to make informed decisions can find themselves facing FTC scrutiny.

2. Ignoring the FTC’s rules for online testimonials

The FTC has also provided guidance for the publication of online testimonials. Under 16 CFR Section 255, the FTC, “intends to treat endorsements and testimonials identically in the context of . . . enforcement.”

Thus, similar to endorsements, the FTC evaluates internet marketers’ use of testimonials on a case-by-case basis. The key question is whether an internet marketer’s use of a testimonial is likely to be “deceptive” to reasonable consumers. If it isn’t, then there isn’t a problem. But, if it is, then publishing the testimonial could lead to FTC enforcement action.

To be clear, the FTC is not actively monitoring all internet marketers’ use of endorsements and testimonials. This simply isn’t possible; and, even if it was, it wouldn’t be a good use of agency resources. Instead, the FTC primarily relies on consumers and companies to report deceptive advertising practices.

When is a testimonial likely to be considered “deceptive” by the FTC? When evaluating internet marketers’ use of testimonials, the FTC typically analyzes three factors:

  • Do the testimonials used provide an accurate assessment of overall consumer sentiment or typical results (or, has the company selectively chosen positive testimonials)?
  • Are the testimonials legitimate (or, are they fabricated or compensated endorsements)?
  • Has the company included adequate disclosures and disclaimers in order to avoid misleading consumers (or, could consumers get a false impression based on the testimonials published)?

Again, however, there are relatively few hard-and-fast rules. When in doubt, internet marketers should generally err on the side of disclosure or speak with an FTC defense lawyer; and, if there are any internal concerns about whether use of a testimonial may be misleading, these concerns should be taken into account when deciding whether to publish a testimonial online and/or include any disclosures or disclaimers.

3. Creating native advertising that is misleading to consumers

The FTC has also placed native advertising under enhanced scrutiny in recent years. As the agency explains:

“A basic truth-in-advertising principle is that it’s deceptive to mislead consumers about the commercial nature of content. Advertisements or promotional messages are deceptive if they convey to consumers expressly or by implication that they’re independent, impartial, or from a source other than the sponsoring advertiser – in other words, that they’re something other than ads.”

Today, plenty of reputable online news outlets allow the use of native advertising. Here, too, the practice itself is not inherently unlawful. Instead, the question is whether the nature of the advertisement is likely to be misleading to consumers.

In short, will consumers understand that a native ad is in fact an advertisement? Or, are they likely to think that the ad is a news article? If the latter, then clarification and/or additional disclosures will be required.

Depending on the specifics of a particular native ad, the FTC instructs that some or all of the following may be necessary in order to comply with the law:

  • A disclosure in clear and unambiguous language;
  • A disclosure as close to the native ad as possible;
  • Use of a font and color that are easy to read;
  • For video ads, a disclosure that is “on the screen long enough to be noticed, read, and understood;” and/or
  • For audio disclosures in videos, podcasts or other media, “a cadence that’s easy for consumers to follow and in words consumers will understand.”

4. Making false claims of effectiveness or success

False advertising claims are a core focus of the Federal Trade Commission Act (FTC Act) and a multitude of other federal laws and regulations. These laws and regulations prohibit online marketers from making false claims of any kind, but place particular emphasis on claims about the effectiveness of a particular product or a service provider’s record of success.

Any blatantly false claim is likely to draw strict scrutiny from the FTC. The FTC has a number of investigative tools at its disposal, and it uses these tools to aggressively target online marketers suspected of misleading consumers.

This is true in cases involving both intentional misrepresentations and unknowing misrepresentations—with intentional fraud carrying the potential for criminal prosecution.

5. Making unsubstantiated claims

Unsubstantiated claims can lead to just as much trouble as false claims. When making claims about the effectiveness of a product or service, the FTC requires internet marketers to have adequate substantiation. If a factual marketing claim cannot be substantiated (or proven), then it cannot be made.

This applies to specific claims (i.e. ABC Company’s product outperforms XYZ Company’s product) as well as superlatives (i.e. ABC Company is the best in the business). If a marketing claim is capable of being proven or disproven, then making the claim without proof constitutes deceptive advertising under the FTC Act.

Internet marketers don’t necessarily need to publish their substantiation, but they do need to have it on record. In the event of an FTC investigation, having substantiating documentation readily available can be the difference between avoiding charges and facing prosecution for FTC Act violations and other charges.

6. Making deceptive claims (i.e. claims based on half-truths)

Internet marketers must also be extremely careful to avoid making claims that are deceptive because they are only partially true.

Consider, for example, an investment advisor who promotes the fact that dozens of his clients have earned substantial returns. If dozens of other clients have suffered substantial losses, then promoting the investment advisor’s success alone would be considered deceptive advertising under federal law (and under many state and international laws as well).

These types of half-truths seem to have become increasingly popular in recent years. But, while they may be pervasive online, this does not mean that they are acceptable or that the risks of making this type of misleading advertising claim can be ignored. Internet marketers must independently assess their own compliance obligations with an FTC defense attorney, and they must avoid following in others’ misguided footsteps.

7. Failing to maintain adequate data security

Data security is another key enforcement area for the FTC. Companies that have access to consumers’ data have an obligation to protect these data under federal law.

Different types of data are subject to different legal requirements; and, generally speaking, the FTC expects companies with greater resources to deploy greater cybersecurity measures.

With that said, once again, internet marketers need to assess their specific compliance obligations in light of the nature of their online activities, and they must make informed decisions about what is necessary in order to maintain compliance.

8. Violating antitrust laws

Federal antitrust laws prohibit companies from working together to implement anticompetitive practices. They also prevent large companies from gaining monopolies that unreasonably restrain competition in the marketplace.

From supply chain restrictions to mergers and coordination between competing firms, there are numerous issues that can lead to trouble under the extraordinarily complex federal antitrust regime.

Most internet marketers won’t run into antitrust issues in their day-to-day business. But, for those who encounter these issues, compliance needs to be a priority. This is a priority enforcement area for the FTC, and companies can face swift and heavy enforcement action when suspected of engaging in anticompetitive practices.

9. Overlooking the FTC’s free online guidance

The FTC makes many resources publicly available online—including several resources that are specifically intended for internet marketers. Since the FTC puts these resources out there, they expect internet marketers to do their due diligence and put in the time and effort to comply with the law.

However, as mentioned above, much of the FTC’s guidance leaves questions unanswered. The agency provides explanations and examples, but it stops short of telling marketers specifically what is and isn’t permitted.

As a result, while internet marketers can (and should) carefully review the guidance that is available from the FTC, they must also ensure that they are confident in their interpretation of the FTC’s guidance and how they apply it within the context of their particular online marketing activities. This is why a short meeting with an experienced FTC defense lawyer can really put your mind at ease.

10. Ignoring inquiries from the FTC

Finally, in the event of an FTC inquiry, it is imperative to respond promptly and appropriately. This is true whether an FTC agent makes contact directly, the agency issues a subpoena, or the agency makes contact through any other means.

Ignoring an FTC investigation is a big mistake—and it is not one that will go overlooked. Attempting to conceal information or destroy potential evidence can have significant negative consequences as well.

An FTC investigation won’t simply go away. However, taking a proactive approach can significantly increase the likelihood of resolving an investigation without charges being filed.

By taking steps to comply with the law, document their compliance, and prepare in advance for the possibility of an FTC inquiry, internet marketers can significantly mitigate their risk of facing allegations of deceptive advertising (in addition to other civil or criminal charges).

How to Design Your Life for Happiness

Do you sometimes feel like life is a smorgasbord of distractions, chattering monkey mind and societal expectations designed to keep you on the straight and narrow? Instead, you discover you are on the road to a future with little promise and no tomorrow and wonder what happened. 

Many people float through life like a pinball machine. They are bouncing off obstacles, opportunities and barriers at random with no apparent purpose or intent and waiting to exit stage left.

One of life’s biggest challenges is finding purpose, creating an intention and then connecting it to the power of focused attention and acting. Most of us get distracted and wander from shiny toy to shiny toy. Distraction to the next popular attraction. At the whim of others. Wanting to please well-intentioned mothers.

Taking the time to reflect on the question, “What should I do with my life?” and finding a sliver of an answer that whispers to you is hard work. It’s time to stop hiding under the doona, wandering through life with no purpose and just showing up without any focus.

So how do you design a life? 

There is no clear answer, but there are some things you can do to start and supercharge the process. 

School doesn’t teach you how to design “your life”, and often neither do parents. They just want you to be safe and secure. But what that means is that they will try and fit you into their box or pre-determined ideas with protective foam, soft edges and safety handles. They have the best intentions. They want to make sure you don’t get hurt. The reality is that their life expectations for you are not your ideal life, and likely you will not be happy. Just safe. Being true to yourself is a challenge.  

“When I grow up, I want to be me.” 

The challenge is that traveling a road less traveled will have its bumps, darkness and storms. We thrive or drown from pain. Or get lost in pleasure. But the truth is that we don’t learn or grow from pleasure. 

So when tough times show up (and they will), you need to see it as an opportunity. It’s time to grow, learn and have an adventure. Life is too short to live like a round peg in a square hole. Trying to fit into other people’s and society’s expectations. It is time to choose joyful mastery and passionate purpose over a life of conforming misery. 

Start with intentional life design rather than being a compliant pleasing follower

So start designing “your” life. It’s time to choose your unique path and be free to dream. 

So what do you do, and where do you start? 

Step 1: Answer the question. “What makes me happy?” 

“There is no way to happiness. Happiness is the way” Buddha.

You can’t manufacture happiness by working hard at it. You already know what makes you happy, but you have maybe never taken the time to write it down or taken the time to ask the question. But be aware it will have multiple answers.

Also, I don’t mean superficial passing happiness. It sits deeper than that and is woven into your being. It can be as simple as:

  • Listening to music
  • Cycling
  • Gardening
  • Working outdoors
  • Creating: Music, art, writing 
  • Making something with your hands 
  • Learning. You could add what type of learning you love
  • Reading
  • Photography
  • Creating and observing art
  • Helping other people
  • Being around other people

So why choose a 9-5 job that makes you miserable? If you do, you have chosen misery. 

One of the best things I ever did was on a weekend bootcamp where the goal was to reflect and become more self-aware. The Life Mapping exercise on a big piece of butcher paper was revealing and confronting. Think and reflect on what you did as a child and teenager when you were free to dream before you were programmed to fit in. Be careful as this may hurt. It requires you to stop, be quiet and “think”.

About sex

In his book “Don’t Trust Your Gut: Using Data to Get What You Really Want in Life”, Seth Stephens-Davidowitz summarizes what a 3 million data point research project and happiness tracking “app” titled “Mappiness” reveals about what makes humans happy. And it is not that complicated. The data-driven answer to life is as follows: 

“Be with your love, on an 80-degree and sunny day, overlooking a beautiful body of water, having sex.” 

So a quick note about sex. The data found that during sex, less than 30% of participants in the survey were thinking about something else. A study by Killingsworth asked the following question: 

“Are you thinking about something other than what you’re currently doing?” (they also asked whether the other thought was pleasant, neutral, or unpleasant). The study found that 46.9 per cent of the time, a person is thinking about something other than what they are currently doing. The researchers also found that when a person is thinking about something else, they are significantly less happy.*

So amongst many other good things, sex is good at quieting the mind! 

About work and jobs: 

In his book “Freakonomics” Steven Levitt reveals that people who used a coin flip to decide whether to leave or stay in their job “that sucks” they discovered that the people who left were much happier months later. 

Step 2: What am I good at? 

Sometimes you don’t know what you are good at until you do it. Or it could be sitting down and writing down what you think you are good at. It could be asking your friends and family what they have observed in you. 

  • I am good with my hands. Fixing things and making stuff
  • I can create music
  • I’m good with computers
  • I am good at cooking. 
  • Selling
  • Project management
  • Attention to detail
  • Listening and communication

Step 3: What does the world need?

I was conversing with a fellow entrepreneur who has successfully started four companies and exited two. I asked him, “Where do your business ideas come from?” His answer revealed a mindset that is a very effective “ideas machine” but with a purpose. 

As he walks around and goes to cafes, attends meetings and talks to people, he looks for the problems. Then he asks himself, “How can I solve that problem?” It is a mindset of conscious awareness with a purpose. Today he has a list of 200 problems and also has some answers! 

The world needs answers to problems posed as questions. It needs beauty to bring joy to people’s lives. It needs pain to be eased. It needs laughter to stop sorrow from overwhelming souls.

Step 4: What will the world pay you for? 

“When you have a dream, it often doesn’t come to you screaming in your face. Sometimes a dream almost whispers. The hardest thing to listen to is your instincts, your human personal intuition. It whispers; it never shouts. It is very hard to hear”. – Stephen Spielberg

Steps 1-3 are designed to help you hear the whisper. To peel back the noise of life and find your truth and life purpose. 

You just need to discover the one intention to focus your attention and act every day. There may be a few intentions sitting on the shelves labeled:

  • Too hard 
  • Too busy
  • Afraid to fail 

That is just procrastination. So choose the one whispering intention that feels right. Don’t overthink it. 

That intention then needs focused attention. Focused attention is writing down the goal, acting and stepping into the gap. The unknown. Choose the what and don’t worry about the how. The universe will reveal the “hows” (daily actions). 

So what is the one intention that you would like to do? Write down a few and choose “one” that feels right. Listen to your intuition.

So, “What does the world need?” 

Typically that will come from your own experiences and interests and then asking the right questions. 

A simple, practical approach?

Look for problems to solve. The bigger, the better.

  • The Uber founders experienced the challenge of trying to get a Taxi on a wet, cold night in Paris. That was the problem. Then they came up with a global solution.
  • Airbnb founders couldn’t find accommodation during a busy weekend in San Francisco, where the hotels were full and expensive. Another problem. After trial and error, they came up with an answer. The bigger the problem you solve for a big audience, the bigger the difference you will make. 

Step 5: Discover the sweet spot in the middle

Here we take what makes you happy, add into the mix your innate abilities, and add what the world will pay you for. This intersection is where you discover your intention. But it is just a starting point to get you actively thinking. The intersection will be in the middle of the matrix and the unknown possibilities. 

There are three areas that we have listed as the first three steps.

Step 1: Answer the question, what makes me happy? (Love doing)

Step 2: What am I innately good at? (Strengths)

Step 3: What will the world pay me for? (Career and Business)

Write down three ideas that you think the world would pay you for

Write down three of your best ideas and choose the best one. The one that feels right. Maybe the one you road tested at the job you worked at as an intern? Intuition is not perfect, but you will be surprised at its magic. 

Once you have chosen your intention out of the different possibilities, I recommend writing a one-page intention plan with three sections.

One Page “Intention” Plan

  1. Describe your product or service that serves the world. The better you serve the world and solve a problem, the more you will be rewarded. The bigger the problem and the bigger the audience, the better the results. 
  2. Distill that into one sentence so that if someone asks what you do when you get into an elevator, you can tell them before you reach the floor where they are getting off.
  3. Write down all the reasons “why” you are uniquely qualified to do this intention. This will help confirm that what you are doing is right and it is time to act.

Some Notes:

  • Ikigai is the Japanese method of discovering if your career will fulfill you. – Forbes
  • Look at your experiences – List a variety of options. Just write them down without overthinking. 
  • To help here, write a list of what experiences you have had in life.
  • As you travel through life’s adventure, you have spent time working, playing, pursuing passions, and working on specific projects. 
  • The intersection can also be woven into other areas of your life. 
    • Exercise – Eg: Does going to the gym, running, swimming, or dancing make me happy?
    • Hobbies – Eg: Do you get lost in the process and creativity of cooking? 
    • Friends and relationships – Only be in relationships that genuinely make you happy and leave the rest behind.

Step 6: Supercharge your motivation to get started

To help get your mojo and motivation going, try this 2 step exercise. 

  1. The different major goal categories in life are worth pondering. 
  2. Ask the question – Why am I doing this? The more reasons you can list, the more your motivation will be supercharged.

Nine Whys

There are many reasons “why” I am doing this one thing. It seems that the more “whys” you have written down, the stronger your motivation. There are many motivations for “why” you do something that gives you joy. These are both internal and external. The internal is more powerful and sustainable. 

These are my reflections on 9 “why’s” that have motivated me over the years.

1. Satisfy my “Curiosity” (Internal)

This “why” sat at the top when I joined Facebook and Twitter. I was impressed by the tech and also noticed people’s behaviour. Obsession and addiction. It also happened to me. I was looking into the future, and it would be a game changer. I was curious about where the future was going. 

2. It Gives me a feeling of Fulfillment

The sense of fulfillment I had, added to my motivation like fuel to a fire. As I wrote and created and shared I was growing. The website traffic grew. 

3. Provides a sense of “Accomplishment”

Accomplishment sounds like a destination, but it should be a series of ongoing accomplishments that keep you hungry. Finishing a project. A piece of art. Launching and growing a successful business.

4. Receive “Positive Feedback” 

The comments on Twitter and my blog were intoxicating at the time. Not so much now as it is more an internal motivation drive.

5. Given “Affirmation”

I will be acknowledged and affirmed that I am on the right track by other people close to me and in my circle.

The New Rich: How to Live, Flourish and Make Money in a Digital World

So you’re rich, are you? Or at least you’d like to be?

Rich is a term that in the past just meant one thing: “Money”.

We thought that more money made us happy. And up to a certain threshold, it does. But once we have a roof over our head, food on the table and some spending money, its benefits diminish. 

The new rich is more about people that have true wealth. 

What’s true wealth, you ask? 

I will give you a definition you may not find in Webster’s Dictionary.

Do what you enjoy while earning enough money to pay for life, achieve independence and maybe even travel and have an adventure.”

It is not a utopia, as you will have to work and navigate an uncertain future and be on the edge of discomfort. And change has a price.

The easiest way to discover it is with a low-risk strategy. Start a side hustle before you leap into the void of a main hustle (more about this later).

So what is true wealth? 

  • Being happy 
  • Fulfilled 
  • Independent 
  • On purpose
  • Following your calling

True wealth is about all round “well-being” and flourishing. At least that definition makes more sense to me. 

And the fast-changing digital world is a two-edged sword. It has brought us more “money” and provided us with technologies and tools that have made life easier. Still, the modern pace of life and distractions tests our abilities to adapt and manage the increased complexity and stress.

The future of the digital world

I’ve always been fascinated by the future. The Dick Tracey watch, Maxwell Smart’s shoe phone and man landing on the moon. And that was all happening in the 1960s!

And that makes me sound like a mid-century dinosaur that tells “Dad” jokes and embarrasses his children. Well, that is my job and right as a parent!

My imagination ran riot in the ancient past. It was fueled by technology magazines such as “Popular Mechanics”, the Dick Tracey comic strip and the 1960s TV show “Get Smart” which ran from 1965 to 1970.

I was excited about the future before it happened. Imagination is a powerful thing. And dreaming that which becomes a reality is what humans do.

The future is already here

That future has already arrived. It has crept up on us, driven by human imagination and technology, amidst fixed ideas and practices of the past that wrapped us up in inaction disguised as truth.  

It was all based on outdated fixed calcified thinking that no longer quite works like it used to. 

Like…

  • Commuting
  • Having to face to face meetings that waste a lot of time
  • Office towers that are half empty and still have all the lights on
  • Command and control by the corporate titans
  • Working five days a week in a cubicle that’s now moving into a hybrid work world

The bosses are now trying to work out how to provide the right ecosystem as we move forward. Is the command control environment and management still relevant in today’s post-pandemic world?  

Has the trust economy now crept into the office space, and no one was told about it? The bosses thought every employee spent all their days on Facebook and having coffees. Maybe some did.

But it appears that we have underestimated the morality of our employees. We can actually trust them to get “stuff” done. 

So what does the future of business and work look like?

It’s a bit messy, and we are still working it out. What was a slow evolution turned into revolution. Ten years of change have been compressed into two.

We knew it was coming, but not at lightning speed. And an invisible virus was the facilitator. 

So here are my utopian thoughts on what the future of work (and business) looks like in the middle of this short period of a dystopian moment in time:  

Business and work are becoming: 

  • Remote and local. The new formula looks like three days at the office and two days working from home. Who saw that coming?
  • Hybrid and sometimes rabid (It is a bit chaotic, and we are still working it out as we go)
  • Contract workforce (these extensions of you can be found on UpWork and Freelancer.com, amongst other platforms)   
  • We can work from anywhere in the world
  • The team is connected and supercharged by technology. The new tools Trello, Google Docs, and Slack have become my best friends!
  • Free and low-cost technology platforms enable productivity
  • High-speed internet enhances communication. Video and audio. All we are missing is the touch of another human.
  • Business is now global and not just local. The opportunities and market size has gone from finite to infinite. 
  • Collaboration is driven by anonymous trust. We do business with people we have never met. So you need to adapt your business practices to reduce risk. But I have been surprised by how well this works.
  • We pay people and businesses from payment platforms that didn’t exist a few years ago. 
  • We sell goods created by someone else and delivered by an outsourced fulfilment platform we trust (Eg: Amazon
  • We work and live in offices that are not long-term leases but short-term and flexible (Eg: AirBnB and WeWork) 
  • Digital nomads roam the earth bringing dollars and prosperity to remote villages and cafes that don’t speak our language
  • Business visas are being offered to the travelers that bring “IP” and dollars to countries that see the future. These are now called “Digital Nomad Visas” 

This high-speed reinvention of how we live and work pushes the edges of imagination. This evolution of business has compressed a decade of change and how we work into just two years. 

It leads to perturbation. But it is exciting. 

And one easy and low-risk way to take advantage of this generational change is to start a side hustle.

Content Not Engaging Enough? Here’s How to Fix it Fast

No one engaging with your posts on social media? Are your ads returning zero results? The problem could be that your content is simply not engaging enough.

If you’re stuck on how to fix this problem, you’re in luck, this article will help you.

Below I’ve put together a list of the biggest reasons why your content is not engaging your audience. I’ve also included suggestions on how to fix this issue pronto. Let’s dive in!

Reason 1: Your content isn’t speaking to your market’s pain points

The first reason why your content may not be hitting the mark is simply that it doesn’t match the needs of your target audience.

For example, your primary source of content distribution may be emails – but if your target audience is millennials, only 22% of them read emails. You’ve picked the wrong content strategy!

When it comes to content creation, don’t rely on guesswork or your “gut feeling”. Go with the data.

With a vast amount of data at your disposal, marketers need to base their strategy on data, not on their own assumptions. This data may include demographics, online behavior, personal preferences, and favorite content distribution channels. 

You might also find that people visit your website, read your blog and interact with your content – but that’s it, you don’t get any conversions. The reason for this is likely the same: your content does not offer these visitors the value they are looking for. 

How to fix it?

The first thing that you’ll need to do is take a step back and perform a thorough analysis of your target audience.

You’ll need to identify your perfect customer and their primary needs as well as the biggest pain points. By knowing and understanding the problem, you’ll be able to provide a relevant solution.

Second, review your current content and see whether it addresses the identified problems and needs or is completely irrelevant. It may happen that you’ll have to rewrite your content and even rethink your content strategy – but in a long run, it will reward you with tangible results in the form of conversions.

Reason 2: You are talking in “marketing language”

This one may be a bit confusing. Since you are doing marketing, it is only natural to talk to users in “marketing language”, isn’t it?

In fact, not really. It’s users who take the lead today and they approach your product after conducting thorough and independent research beforehand.

So the old-school marketing pitches do not work anymore. As Doug Kessler, the creative director of the Velocity Partners B2B marketing agency, put it, “Traditional marketing talks at people. Content marketing talks with them.” And that’s one area where modern marketers still miss the mark.

There are several proven methods of turning your copy from an overly pushy one to persuasive and user-friendly. Let’s look at each in detail.

Identify your brand voice

Every brand is unique and hence, every brand promotes its own values and vision through content. One of the easiest ways to level up your content game is by adding your brand identity to the content that you create.

And for that, you need to have a clear understanding of your brand identity and of how your brand positions itself.

Do you want to be perceived as bold or innovative or are you taking pride in your old-school traditional approach? The way you want to be seen should dictate the tone of your copy and the way you talk to customers. 

Offer new perspectives and unique insights

Due to the availability of information, customers can easily research common facts and general perspectives on any topic.

To stand out and attract their interest, you can offer them a unique perspective coming from your own unique experience – and that’s something they can obtain only from you.

Review your content and see whether you can add unique insights and personal stories to it. This will make your brand stand out and will contribute greatly to customer engagement.

Promote two-way communication

While “marketing language” is more about a monologue where a potential customer silently listens in awe, a truly engaging copy promotes a dialogue.

That means a customer gets an option to interact with the content or reply to a piece of content. The simplest example of such dialogue is when a customer leaves a comment under a blog post – this shows that the post was engaging and thought-provoking.

Reason 3: Your content is not aligned with the user journey

A user journey is a path that a user takes to reach their goal and it consists of user stories – descriptions of actions that users take throughout the journey. An example of a user story can be online in-app payment and an example of a user journey can be ordering food online via an app.

The main idea behind designing a user journey is to naturally lead a customer towards the needed action and guide them towards their goal.

In other words, you are assisting them on the way with road signs – but road signs have to align with the route. The lack of alignment between your content and the designed user journey can lead to confusion and even discourage customers from further interaction with your product.

How to fix it?

The most obvious thing to do is to review your current user journey and see whether it actually leads a user towards your end goal. Here are some things that might help you revise your user journey strategy:

  • Define the expectations and pain points of your target audience. By understanding what users come for, it will be easier to interest them from the start.
  • Identify the emotions that users experience throughout the user journey and adjust your content accordingly.
  • Identify the biggest touchpoints (i.e. customer support, onboarding, a product demo) and assess whether they provoke interaction or can be improved slightly.
  • List down the steps users take when interacting with your product and the reasons for these steps. For example, if they come to your website, why do they do it? What are they looking for?  
  • See whether there are any bottlenecks in the current user journey and eliminate them.

Reason 4: You lack strong CTAs

Call-to-action buttons are your little helpers when it comes to leading a user towards the needed action or towards a needed piece of content. You’ve seen the “Learn more” or “Read our blog” buttons on any app – these are the most common examples of this.

However, if a CTA is weak (i.e. does not encourage users to take any action) or misleading (i.e. a user simply cannot see it or does not understand it), it won’t bring any good results.

This is a common reason why people do not engage with your content.

How to fix it?

Offer value

In order to engage with your content, people need to understand why they have to do it.

Say, they have not read your blog yet so they do not know it will provide answers to their questions. Thus, if you have a CTA that leads to the blog, it has to clearly state the value people will get after clicking on it. 

Personalize your CTAs

A good way to improve your CTA game is by personalizing the message from a generic “Click here” to a more brand-specific one.

Examples of good CTA messages are “Give me my free eBook”, “Find your perfect glasses”, or “I’m in!”. As you can see, all these CTAs are quite carefree, straight to the point, and quite memorable. Try stepping back from the standard CTA messages and making them a bit more unique and relevant to your brand tone.

A call-to-action button has to stand out from the rest of the application in order to grab attention.

Therefore, make sure it has a distinctive color, is bigger than other elements, and can be instantly seen. It’s also recommended to place CTAs either on top or in the middle of a page so it’s on the eye level of users.

Reason 5: Users can’t find your content

Last but not least, another reason why your content does not engage users is simply that users cannot find it. And even though it’s 2022 and SEO optimization has become a must, some applications still struggle with it.

And if a browser cannot find your product, how do you expect them to engage with it?

How to fix it?

Search engine optimization is a vast topic and the best thing you can do is hire an SEO specialist to take care of your content. However, you can start with some general tips that include:

  • Research relevant keywords and review whether your content contains them;
  • Optimize your current meta descriptions and title tags;
  • Use free plugins for SEO optimization;
  • Use relevant headlines (H1, H2, H3, H4) and add keywords to them;
  • Monitor the performance of your product constantly.

In the modern world where users are overwhelmed with all forms of content, it is essential to offer them something clear, straightforward, and valuable. And even though the content is quite often overlooked and business owners prefer focusing on UX/UI design and product functionality, it’s these small snippets of text that can make a grand difference.
